U.S. Federal Court strikes down visa suspension for 75 countries, including Brazil
The consular pause is over. We have just read the U.S. Federal Court decision striking down the suspension that blocked the issuance of immigrant visas to citizens of 75 countries, including Brazil. If you were waiting to file your Green Card case, or already have one in progress, that picture has changed.
What changes in practice
Cases that had been frozen because of this measure can resume their normal course at the consulates. And refusals grounded solely on this suspension have also been vacated, and are to be reconsidered.
The suspension falls: the decision strikes down the measure that blocked immigrant visa issuance for citizens of 75 countries. Brazil is among them.
Cases move again: cases held up at the consulates because of this suspension can resume their normal course.
Refusals vacated: refusals based solely on this suspension have been vacated and are to be reconsidered.
If you were waiting: anyone who put off filing while waiting for clarity now has the path open again to submit their petition.
"A major win for thousands of Brazilians who were waiting for clarity to move forward with their cases. We are following the implementation of this decision closely." Piquet Law Firm immigration team, Miami.
It is Saturday and we are here
We are in the office today, as an exception, to handle the volume of calls that has come in since the decision was published. The news brought hope to a great many people, above all to clients whose Green Card cases are already under way and to those who were on hold, waiting for the right moment to begin.
